Myndigheternas försök att upprepade gånger åsidosätta yttrandefriheten under Karl XIV Johans regering resulterade inte bara i konfiskation av oppositionella tidningar utan också i ett antal stämningar om majestättsbrott. Bland de mest anmärkningsvärda händelserna var åtgärderna mot Anders Lindberg, Magnus Jacob Crusenstolpe och Napoleon Berger. Napoleon Berger publicerade, i mitten av april 1838, 'Den Röda boken eller några av dagens frågor, av Per Fas'. Den innehåller en hel del kritik av den aktuella situationen. Således anklagades regeringen till exempel för att kväva handel och industri, för att inte låta pressen uttala sig "om sanning och rättvisa" och för eftergifter i sina förbindelser med ärkefienden Ryssland. Napoleon Berger åtalades för sina uttalanden både om kungen och om en utländsk makt och åklagaren, J. G. Fredholm, fick i uppdrag att konfiskera återstående exemplar av skriften. En jury förklarade Berger skyldig och dömde honom till 12 års fängelse för båda dessa brott. När domen tillkännagavs i juni 1838 hade Berger lämnat Sverige. Han bosatte sig i Schweiz, blev förespråkare för marxistisk socialism, samarbetade med Friedrich Engels och var tvungen att gå i exil igen.
